WM3 lists 08 01 11* as a mirror hazardous entry for waste paint and varnish containing organic solvents or other hazardous substances. Classification depends on the composition of the waste and cannot be decided from colour or the presence of one named ingredient.
A water-based product is not automatically non-hazardous waste. Additives, contaminants introduced during use and the hazardous properties of the resulting waste still have to be considered in the mirror-entry assessment.
Paint waste and physical form
Unused paint, process washings, sludge, dried residues and packaging are different materials. The waste description should match what was produced and the process that produced it rather than applying one paint code to every item from coating or decorating work.
The supplier SDS is useful evidence for the original product. Mixed washings or residues from several products can contain a different combination of substances, so the process history and information for each relevant product may be needed.
